26 Kansas Senators Apparently Think It’s Fine For You To Go To Prison For Playing Online Poker

A bill up for consideration by Kansas law-writers received an amendment this week to prohibit Internet gambling within the state. It appears that under the new provision playing online poker, as well as offering it, could be a misdemeanor (possible jail for up to six months).

Sen. Jacob LaTurnerHouse Bill 2055 aims to tackle multiple issues (apparently) facing the state. Below is the amendment language penned by Sen. Jacob LaTurner.

I move to amend Senate Substitute for HB 2055, Corrected, on page 46, following line 37, by inserting:
“New Sec. 30. (a) Internet or online gambling is:
(1) Gambling or gaming by use of the internet;
(2) gambling or gaming by use of any mobile device; or
(3) intentionally providing or offering to provide any form of internet or online gambling or gaming to any person in this state.
(b) Internet or online gambling is a class B nonperson misdemeanor.”;

LaTurner did not return a request for comment made on Wednesday, and his office said he was unavailable when Card Player called again on Thursday seeking an interview.

On the same day it was proposed, LaTurner’s amendment was passed by a 26-11 margin in the Senate chamber. Here are the results — Yeas: Abrams, Apple, Arpke, Bruce, Donovan, Emler, Fitzgerald, Holmes, Kerschen, King, Knox, LaTurner, Longbine, Love, Lynn, Masterson, O’Donnell, Olson, Ostmeyer, Petersen, Powell, Pyle, V. Schmidt, Smith, Tyson, Wagle; Nays: Bowers, Denning, Faust-Goudeau, Haley, Hawk, Hensley, Holland, Kelly, Melcher, Pettey, Wolf; Present and Passing: Francisco, McGinn, Pilcher-Cook.

The move is similar to that of Washington state, which criminalized online poker play years ago. However, no one has ever been prosecuted there for the activity.
